A father dies and leaves a bank account, a house and a small piece of land. His family has his death certificate and a NADRA Family Registration Certificate (FRC). But the bank asks for a succession certificate, while the property office asks for different papers. Does the family need three certificates?

This confusion is common. A legal heir certificate, a succession certificate and a Letter of Administration do not always serve the same purpose. The correct document depends on what you need to prove and which asset you want to claim.

This guide explains the differences in simple English, with examples and practical steps for families in Pakistan.

Quick Comparison: Which Document Do You Need?

DocumentMain purposeWhat it does not automatically do
Legal heir / heirship proofHelps establish who the deceased person's legal heirs are, as required by a particular office or procedureAuthorize withdrawal of every bank balance or transfer every property
NADRA FRCShows family composition recorded in NADRA's databaseDecide final inheritance shares or prove that no heir was omitted
Succession CertificateUsually enables lawful claims to movable assets, such as eligible bank funds and securitiesReplace every property title or land-transfer procedure
Letter of Administration (LoA)Used in NADRA's succession framework for immovable property, such as a house or landAutomatically update a land record or settle a disputed title

The simplest rule: First identify the asset. Then ask the bank, housing society or land-record authority for its written document requirements. NADRA distinguishes succession certificates for movable property from Letters of Administration for immovable property.

What Is a Legal Heir Certificate?

A legal heir is someone entitled to inherit from a deceased person under the law that applies to the family. A legal heir certificate or heirship document is generally requested to help establish who those people are.

But the term “legal heir certificate” is not one uniform NADRA document with the same issuing authority and legal effect throughout Pakistan. Different offices may use expressions such as legal heirship certificate, surviving family record, warasat nama or heirship declaration for documents used in different procedures. Their legal value is not necessarily identical.

For example, a land office may need family details to process an inheritance mutation, while a bank may demand a formally issued succession certificate before releasing funds. Do not assume that a document accepted by one office must be accepted by another.

Ask the receiving office: “What is the exact name of the document you require, who must issue it, and which law or procedure applies?”

Is a NADRA FRC the Same as a Legal Heir Certificate?

No. A NADRA Family Registration Certificate records the family information available in NADRA's registration system. It is useful for establishing relationships and is one of NADRA's published succession application requirements.

However, an FRC is not automatically a final legal determination of every heir or their inheritance shares.

Consider a man who married twice. If a spouse or child is missing from the registration record, the FRC may be incomplete for succession purposes. That person's possible inheritance rights cannot simply be ignored because their name is absent from a printout.

In a Sindh High Court inheritance matter, the court explained that NADRA family records can be relevant evidence, but their absence or incompleteness should not by itself defeat a deserving heir's claim.

Remember: An FRC helps you check family records. It is not a shortcut for deciding a contested inheritance.

What Is a Succession Certificate?

A succession certificate is a formal legal instrument used to claim certain movable assets of a deceased person. These may include eligible bank balances, debts owed to the deceased and securities, depending on the asset and institution.

Example: A mother dies with Rs. 800,000 in a savings account. Her children produce her death certificate and their CNICs, but the bank requests a succession certificate. The certificate provides the legal authority required for the relevant claim; the bank may still complete its own checks before releasing money.

A succession certificate does not mean the person who filed the application owns the whole estate. The rights of the other lawful heirs still matter. Nor does it conclusively resolve every dispute about ownership or whether someone is an heir.

What Is a Letter of Administration?

A Letter of Administration (LoA) is the document NADRA identifies for an estate involving immovable property—such as a house, flat, plot or land—under the applicable succession framework.

Example: A father dies leaving a residential plot in Karachi. His legal heirs may need the relevant Letter of Administration and must then satisfy the housing society, land authority or other record-keeping body's transfer requirements.

Getting a Letter of Administration does not automatically place every heir's name in the land record. A separate transfer, inheritance mutation (intiqal), or society procedure may still be necessary. For example, the Punjab Land Records Authority's mutation guidance explains how official land-record entries are updated.

An LoA is also not a guaranteed answer to allegations that the deceased never owned the property, that a deed is forged, or that a relative has been excluded. Those issues may require evidence and court proceedings.

Bank Money, House or Land:

Real Examples

Example 1: A bank account after the husband's death

A widow visits the bank with the death certificate and FRC. The bank says these documents do not authorize release of her husband's deposit. She should ask which succession certificate and other bank forms are required rather than applying for a property Letter of Administration.

Example 2: Brothers and sisters inherit a house

Three siblings and their mother inherit a house. They must first establish the complete list of lawful heirs and the relevant property records. If the estate is suitable for NADRA's administrative route, an LoA may be appropriate, followed by the property authority's transfer steps. One brother cannot assume the house is his alone because he submitted the application.

Example 3: Agricultural land in Punjab

A daughter is told that an FRC alone will transfer her late father's agricultural land. In fact, inheritance mutation involves the relevant land revenue process, heirship inquiry and records. The Punjab Land Revenue Rules provide for an inquiry into legal heirs and their shares in inheritance mutations. The applicable route should be checked with the land-record office.

Example 4: Both a bank balance and a plot

The deceased left Rs. 2 million in a bank and a plot. The family may require a succession certificate for the bank funds and an LoA for the plot, followed by any additional institutional procedures. One document should not be assumed to cover both simply because the heirs are the same.

NADRA or Court - Where Should You Apply?

NADRA's succession route is designed to make suitable, verifiable applications easier. Under the Letters of Administration and Succession Certificates Act, 2020, applicable to Islamabad Capital Territory, NADRA can process qualifying applications, while unresolved factual controversies may require the proper judicial forum. Provincial succession legislation must be checked separately.

A dispute may arise where:

  • A daughter, widow or other possible heir was left off the list.
  • Family identity records conflict.
  • An heir disputes a signature, marriage, relationship or claimed ownership.
  • A minor heir is involved and the applicable statutory route requires judicial consideration.
  • Someone objects to the application or alleges a forged property document.

Do not hide an heir to make the process faster. Under the 2020 ICT Act, an unresolved factual controversy is a reason for NADRA to decline the administrative assessment. The official text of the Act explains the distinction.

Overseas family members can also be legal heirs. The Pakistan High Commission in London also provides official guidance on the succession process.

Documents and Mistakes to Avoid

Before applying for anything, prepare a basic estate file:

  1. Death certificate and, where required, the deceased's CNIC cancellation certificate.
  2. Updated FRC and identity documents for all potential legal heirs.
  3. Bank, share, investment, property or land documents identifying each asset.
  4. Marriage, birth or other family records needed to resolve missing relationships.
  5. Existing court orders, wills, gift deeds or other relevant records, if any.
  6. The receiving institution's written checklist and any required authorization from the heirs.

The most expensive mistakes often happen before the application: applying for an LoA when the problem is a bank balance; relying on an incomplete FRC; omitting a married daughter; or paying a fee before checking an objection or ownership dispute.

Practical tip: Make a separate line for every asset: What is it? Whose name is it in? Which authority controls it? What document has that authority requested? This simple list prevents unnecessary applications.

Frequently Asked Questions

1. Is a legal heir certificate the same as a succession certificate in Pakistan?

No, not necessarily. Heirship proof identifies people who may inherit; a succession certificate is a specific legal instrument used for eligible movable-asset claims. Always confirm the exact document requested.

2. Can I withdraw money from a deceased person's bank account using only an FRC?

An FRC alone will not necessarily satisfy the bank. The institution may require a succession certificate and additional documentation. Ask for the bank's written requirements.

3. Is a Letter of Administration needed for property in Pakistan?

Under NADRA's published succession framework, an LoA is the document category for immovable property. The exact requirement and later transfer steps depend on the province and the property authority.

4. What is the difference between an FRC and a warasat nama?

An FRC records registered family composition. Warasat nama may be used informally for heirship or inheritance documentation, but its meaning can vary by office. Ask who issues the requested document and what it legally proves.

5. Can a married daughter inherit if she is not shown on the FRC?

A lawful heir's rights are not automatically lost because of a missing NADRA entry. The family record may need correction and the heir's legal status may need proof under the applicable personal law.

6. Can one brother apply on behalf of all heirs?

Where the relevant succession law permits, one heir may apply with the required authorization from other heirs. That does not entitle the applicant to keep their shares.

7. What if one heir objects to NADRA's succession application?

A genuine unresolved dispute can prevent ordinary administrative processing. Obtain the written reason and check the appropriate legal forum under the relevant provincial or federal law.

8. Does a succession certificate automatically transfer a house?

No. A succession certificate is generally for movable assets. An LoA and further property transfer or mutation requirements may apply to a house.

A Simple Way to Choose Your Next Step

Start with three questions:

  1. Who are the heirs? Check the family records, but do not treat the FRC as a final legal ruling.
  2. What was left behind? Separate bank funds and securities from houses, plots and land.
  3. Is anyone disputing the estate? If yes, check the correct legal forum before starting a routine NADRA application.

Bottom line: A legal heir document helps identify heirs; a succession certificate deals with eligible movable assets; and a Letter of Administration is used for immovable property under NADRA's applicable framework. The document's purpose, not just its name, determines what you should apply for.
