A Power of Attorney can be useful when you need someone to manage property, bank work or legal documents in Pakistan. But what if you no longer trust that person, the job is finished, or you fear they may sell your property without permission?

You can often revoke a Power of Attorney in Pakistan, but sending a clear notice is essential. Simply tearing up your copy may not stop the agent from using another copy. You may also need to alert the registrar, housing society, bank or other people who could rely on the document.

This guide explains how to cancel a Power of Attorney in Pakistan, including a General or Special POA, registered documents, overseas revocation, an example notice and steps to take if the agent has already acted.

Can You Cancel a Power of Attorney?

In many ordinary agency arrangements, yes. The person granting authority (the principal) can withdraw it from the person acting on their behalf (the attorney or agent). The attorney does not have to be a lawyer.

For example, Sara lives in London and authorizes her cousin in Karachi to obtain a copy of her property record. Six months later, Sara decides to handle the work through somebody else. She can normally withdraw the cousin's unused authority by communicating the revocation properly.

But not every POA can be ended on identical terms. An agent may already have completed a legally binding act, or may hold a genuine interest in the subject matter. Both situations need special attention.

What Does Pakistani Law Say?

The main rules are in sections 201–208 of the Contract Act, 1872:

ProvisionWhat it means in simple English
Section 201Agency may end through revocation, completion of the task or certain other events.
Sections 202–204An agent's protected interest or acts already completed can limit what revocation changes.
Sections 205–206Some early terminations may involve compensation; reasonable notice matters.
Section 207Revocation may be express or implied, though written proof is far safer.
Section 208Termination does not take effect against an agent or third person before it becomes known to that person.

Section 208 is especially important. If a buyer or bank does not know that an attorney's authority was withdrawn, legal complications can arise. This is why a revocation notice should be communicated, not merely signed and kept in a drawer.

In Syed Monis Raza v. Mst. Asia Bano, the Lahore High Court stressed the need for notice to the attorney. Its official case-law bulletin discusses this point.

How to Revoke a POA?

Six Steps

Step 1 - Find the original POA and check its powers

Read the complete document. Note its date, names, CNIC/NICOP details, property or transaction, registration number if any, and the powers granted. Look for an expiry date, an “irrevocable” clause, any money paid by the agent, and acts already carried out.

Do not assume that a General POA is automatically more difficult to revoke than a Special POA. The actual rights and obligations matter more than the title.

Step 2 - Prepare a clear revocation notice

Identify the original POA and state that you are withdrawing the specified authority. Include the effective communication date, a request to stop acting, and instructions to return documents and account for money or records held on your behalf.

For a disputed or registered property POA, a properly drafted revocation deed may also be useful to create an official record. Whether it must be registered depends on the applicable law, court guidance and receiving authority.

Step 3 - Serve the notice on the attorney

Send the notice by a method that provides proof of delivery—for example, registered courier or another verifiable method. Where appropriate, also send a copy by email or message and keep the delivery history.

Do not rely only on a notice you never delivered. Section 208 distinguishes when termination becomes known to the attorney and when it becomes known to third parties.

Step 4 - Notify the offices that might accept the POA

If the POA concerns a property, send written notice to the relevant Sub-Registrar, housing society, land-record office or development authority. For bank matters, notify the branch or institution. If it concerns litigation, inform the handling lawyer and court through the proper procedure.

Attach a copy of the POA and revocation notice, request acknowledgment and ask whether the office needs a registered revocation or entry in its record.

Step 5 - Consider a public notice when third parties may be affected

For a property-sale POA, a newspaper notice may help warn potential buyers and create evidence that the cancellation was publicly communicated. It is not a substitute for notifying a known attorney or a known buyer.

A public notice is not automatically required for every small administrative POA. Use the step when the circumstances justify it, especially if an agent may try to deal with unknown purchasers.

Step 6 - Protect the records and verify that no transaction is pending

Keep the notice, courier receipts, office acknowledgments, any registered instrument and newspaper publication together. Ask for current title or mutation information if the POA involved land or a plot. Confirm in writing that the person no longer has access to documents, bank instructions or transaction files where applicable.

Example: A father revokes his son's authority to sell a plot, but only tells the son verbally. The buyer and housing society continue dealing with the son. Even if the father intended cancellation, proving who knew what and when may become the central dispute.

Do You Need a Registered Cancellation Deed?

Not necessarily in every case. There is a difference between the legal communication of revocation and the practical steps needed to protect the property record.

In Abdul Majeed v. Jawed Hameed & others, C.P. No. D-6089 of 2025, order dated 2 February 2026, the Sindh High Court considered a General POA that had been revoked through a newspaper notice, with information also given to the Sub-Registrar. The court explained, in the context of that case, that a formal registered cancellation deed was not itself indispensable where the revocation had been communicated to the attorney.

Other decisions have emphasized notice, proof and the protection of transactions already undertaken. Do not treat one judgment as a universal instruction to skip registration or office notice. If the POA was registered or used for a property transaction, ask the relevant Sub-Registrar what cancellation record or filing it will accept, and obtain acknowledgment.

A signed cancellation paper is not the same as having all affected parties informed.

How to Cancel a POA from Abroad?

If you live in the UK, UAE, Saudi Arabia, USA or elsewhere, you may be able to prepare the revocation abroad and have it authenticated through the appropriate route. The exact form depends on where it was signed, whether the original POA was registered, and which office in Pakistan must act on the cancellation.

A practical plan is to:

  1. Obtain the original POA details and a draft revocation identifying it precisely.
  2. Check with your Pakistani Embassy/Consulate and the receiving authority in Pakistan whether consular attestation, local notarization, legalization or a registered document is required for the intended filing.
  3. Deliver an authenticated copy where required to the attorney, Sub-Registrar, society or other institution, keeping verifiable proof.
  4. Ask a trusted independent person to confirm that any required entry or notice is received and that no unauthorized transfer is being processed.

The Ministry of Foreign Affairs consular guidance explains its procedures for overseas POAs. Its published 120-day period concerns attestation/re-verification, and should not be confused with a blanket 120-day life span or cancellation deadline for every POA.

Important: Do not assume that submitting a new request through the NADRA online POA portal automatically cancels an old POA everywhere. Confirm the actual revocation procedure with the mission and Pakistan-side office.

Can an Irrevocable POA Be Cancelled?

An agreement labelled “irrevocable” is not decided by that single word. Section 202 of the Contract Act protects an agency where the attorney has a genuine interest in the subject matter and termination would prejudice that interest, subject to the law and the actual agreement.

For instance, if a person has validly authorized an agent to sell property and pay a genuine debt owed to that agent from the proceeds, the agency may be coupled with an interest. Ordinary termination rules may not apply in the same way.

But merely writing “irrevocable” on a general document does not automatically prove that the agent has purchased the property or owns it. Review the underlying sale agreement, payments, consideration, title records and actual legal interest before attempting cancellation.

Also note section 204: withdrawing authority does not automatically undo obligations arising from acts properly undertaken before revocation.

Simple Power of Attorney Revocation Notice

The following is an illustrative notice, not a substitute for a correctly drafted deed or the form required by a registrar:

Subject: Notice of Revocation of Power of Attorney

I, [full name and CNIC/NICOP], hereby notify [attorney's full name and CNIC] that I revoke the Power of Attorney dated [date], concerning [property, case or task], registered as [number and office, if applicable]. You are instructed to stop acting or representing yourself under this authority upon receipt of this notice, subject to any rights or obligations that the applicable law preserves. Please return documents and provide a statement of any actions taken or funds received on my behalf.

Date: [date]
Signed: [principal's signature]
Contact for acknowledgment: [email/address]

Send separate notices to relevant third parties and identify the specific document in each notice. If a transfer is disputed or an attorney may claim a protected interest, obtain case-specific legal review before serving a final notice.

What If the Attorney Already Sold the Property?

Cancellation now does not automatically undo a completed sale. First establish when the attorney signed the agreement or deed, when revocation was communicated, whether the authority covered the sale, and what the buyer knew.

If the attorney exceeded authority or used a forged POA, a civil claim for declaration, cancellation of a written instrument, injunction or other appropriate relief may be available. Section 39 of the Specific Relief Act, 1877 deals with cancellation of void or voidable instruments in qualifying circumstances.

Do not assume that revoking an old POA automatically removes a registered sale deed or mutation. Obtain certified copies, preserve communication records, and act promptly where a transfer is pending. A court may need to examine the POA, ownership records, consideration, agent's conduct and the rights of later purchasers.

Frequently Asked Questions

Can I cancel a General Power of Attorney without going to court?

Often, an ordinary revocable POA can be withdrawn without first obtaining a court order. Effective notice and record requirements still matter. Disputed or interest-coupled authority may require legal proceedings.

Can I cancel a registered Power of Attorney?

Potentially, yes. But check the applicable registration procedure and communicate revocation to the attorney and affected third parties. Keep written proof, especially for property matters.

Is a newspaper notice enough to cancel a POA?

Not always. Publication can support proof of public communication, but you should also give direct notice to the attorney and known institutions or prospective buyers. The legal effect depends on who knew of the revocation and when.

Can I revoke a Power of Attorney while living in Dubai or London?

Yes, in many cases, subject to the POA and law. Check the authentication and filing requirements of the relevant Pakistani mission and Pakistan-side authority. Remote execution does not remove the need to communicate the revocation.

Does a POA automatically end when the principal dies?

An ordinary agency generally ends on the principal's death under section 201, subject to exceptions such as section 202 and the rules on knowledge of termination. Heirs should notify affected offices rather than assume records instantly update.

Can an attorney keep using my POA after I tell them it is cancelled?

If a valid revocation has been communicated, continuing to act may be unauthorized. But disputes can arise over notice, prior transactions or protected interests. Inform affected third parties and preserve the evidence.

Can I cancel an irrevocable POA if the attorney cheated me?

Fraud or action outside authority may provide grounds for legal challenge, but the document cannot be assessed by its label alone. Review the alleged fraud, actual interest, documents and completed transactions.

Does a Power of Attorney cancellation reverse a sale deed?

No, not automatically. A completed sale may need a separate legal challenge. Revocation concerns the agent's authority; cancellation of a sale instrument is a different legal remedy.

Final Safety Checklist

Before treating the POA as cancelled, check that you have:

  • Identified the exact original POA, its registration details and powers.
  • Checked for any genuine interest, pending sale or act already completed.
  • Sent clear notice to the attorney, with proof that it was received or communicated.
  • Notified registrars, banks, societies, courts or known buyers, as relevant.
  • Completed any registration, attestation or record-update steps required by the office involved.
  • Preserved copies, receipts, acknowledgments and the current property record.

Bottom line: Revoking a Power of Attorney is not just writing “cancelled” on a document. The key is lawful withdrawal of authority, clear notice, proof of communication and protection against later misuse.
