Child maintenance is intended to provide financial support for a child's reasonable living, educational, healthcare and developmental needs. When parents disagree about the amount, the Family Court assesses the circumstances and available evidence rather than applying a universal monthly rate.

A child maintenance calculation generally involves examining the child's actual expenses, the father's financial means and resources, the family's circumstances and the applicable legal provisions. A parent's employment abroad, irregular business income or lack of formal salary records can make that assessment more complex.

This guide explains how maintenance amounts are assessed, what financial documents may help establish a claim, how interim support works and what overseas parents should consider when financial evidence is held in another country.

How Do Family Courts Determine Child Maintenance?

Family Courts consider relevant financial circumstances and the child's needs when deciding an appropriate maintenance amount.

There is no single fixed percentage of salary that automatically determines child maintenance in every case under Pakistani family law.

The assessment may involve several connected factors:

Assessment factorWhat the court may examine
Child's age and needsAge, health, education and reasonable daily requirements
Education expensesSchool fees, books, transport and other justified costs
Medical expensesRegular treatment, medicines and special healthcare needs
Living expensesFood, clothing, housing-related needs and everyday care
Father's financial capacitySalary, business income, assets and available resources
Family circumstancesRelevant living arrangements and financial responsibilities
Inflation and changing costsEvidence of increased living and educational expenses

The purpose is to arrive at a legally supportable amount on the facts of the particular case.

The court should not be asked to accept an arbitrary figure without examining the evidence supporting it.

What Expenses Are Included in Child Maintenance?

Child maintenance is not limited to food or a basic monthly allowance.

The expenses claimed should reflect the child's reasonable needs and relevant circumstances.

Education and School Fees

Education may form a significant part of a child's monthly and annual expenses.

Supporting documents can include fee vouchers, school invoices, admission charges, books, uniforms, examination fees and transport records.

Where school fees are paid quarterly or annually, those costs should be identified separately instead of being inaccurately described as monthly payments.

Food, Clothing and Daily Living Expenses

Ordinary expenses may include food, clothing, personal hygiene, daily care and other reasonable necessities.

The claimed amount should be supported by a practical explanation of the child's living circumstances.

Medical Treatment and Healthcare

Healthcare requirements may include consultations, medicines, diagnostic tests, recurring treatment and documented special medical needs.

Where a child has a medical condition requiring continuing care, reliable supporting records may be particularly important.

Accommodation and Related Expenses

Housing-related expenses may form part of the overall assessment, depending on the circumstances.

However, the entire household rent or utility bill should not automatically be attributed to one child without a reasonable basis.

Additional or Exceptional Expenses

Certain children may have special educational, therapeutic or other demonstrable needs.

Such expenses should be presented with evidence explaining their necessity and expected cost.

How Does the Father's Income Affect Child Maintenance?

The father's financial capacity is an important consideration in Muslim child-maintenance disputes, subject to the applicable personal law and facts.

The court may examine salary, business activities, assets, available resources and other relevant information.

An applicant should not assume that the amount of maintenance is determined exclusively by the salary shown on one employment certificate.

Salaried Employment

Where the father is employed, relevant evidence may include salary certificates, payslips, employment documents and other available financial records.

The court assesses the credibility and relevance of the material presented.

Business Owners and Self-Employed Parents

Business income may fluctuate, and some business owners do not receive a fixed monthly salary.

Depending on the circumstances, the court may consider available business records, banking documents, property information and other reliable evidence relating to financial resources.

A claimed lack of fixed salary does not, by itself, establish an inability to contribute toward maintenance.

Unemployment or Reduced Income

Unemployment or reduced earnings require examination of the actual circumstances.

The court may consider the evidence of financial hardship, available resources, earning capacity where legally relevant, and the needs of the child.

No particular maintenance award can be predicted solely from an assertion that the parent is unemployed.

What if the Father Works Abroad?

Cross-border child-maintenance disputes often involve parents living in the UK, UAE, Saudi Arabia, USA, Canada or another country while the child resides in Pakistan.

A foreign salary, overseas business or employment contract may become relevant where a Pakistani Family Court has jurisdiction over the maintenance claim.

However, a parent's foreign residence does not automatically establish the amount payable or determine the correct legal forum.

Overseas Income Evidence

Depending on availability and relevance, records may include:

  • Foreign employment contracts and payslips.
  • Bank statements showing salary deposits.
  • Tax or income documents.
  • Business registration and financial records.
  • Documentary evidence of remittances.
  • Proof of existing maintenance payments.
  • Relevant financial information already produced in court proceedings.

Documents issued abroad may need verification, translation or authentication depending on the applicable court procedure.

Foreign Currency and Exchange Rates

Where financial evidence is expressed in another currency, counsel should distinguish between the original amount and any conversion used for the proceedings.

Exchange-rate evidence should be dated and accurately sourced.

A foreign salary should not automatically be treated as the parent's disposable income without examining relevant circumstances.

International Child Support vs Local Maintenance

International clients often use the term child support, whereas Pakistani family proceedings commonly use child maintenance.

The concepts are related, but statutory formulas and enforcement systems differ across jurisdictions.

A calculation under UK or US child-support rules should not be presented as the formula applicable to a Pakistani Family Court.

How to Prepare a Child Maintenance Expense Statement

A well-prepared expense statement helps the court understand the financial claim.

Rather than submitting one unsupported total, the claimant can organize expenses by category.

Illustrative Monthly Expense Worksheet

Expense categoryEvidence to prepare
Food and everyday careReasonable expense breakdown
School tuitionCurrent school fee voucher
Books and uniformReceipts or school requirements
School transportTransport invoice or payment record
Medical costsPrescriptions, bills and treatment records
Clothing and personal careRelevant receipts or reasonable estimates
Housing-related shareRent and household records, where relevant
Special needsMedical or educational supporting documents

The worksheet should distinguish regular monthly expenses from occasional or annual costs.

Practical example: If a school charges tuition monthly but books and admission expenses annually, the claim should show those costs separately. The court can then assess their frequency and relevance.

This example illustrates evidence preparation, not a statutory maintenance formula.

Avoid Unsupported or Duplicated Expenses

Claims should be accurate and proportionate to the available documents.

An expense already included in school tuition should not be claimed again under another heading without a legitimate explanation.

Similarly, a lawyer should not manufacture bills or exaggerate financial figures.

Credible evidence is more useful than an inflated calculation that cannot withstand examination.

Can Family Courts Examine the Father's Financial Records?

Yes, under applicable statutory provisions the Family Court may have powers to call for relevant financial material.

For example, Section 17-A(4) of the Punjab-amended Family Courts Act, 1964 permits the court to summon documentary evidence from organizations, bodies or authorities to determine a defendant's estate and resources.

This can become important where income information is disputed or incomplete.

The exact power and procedure must be checked against the legislation applicable in the relevant jurisdiction.

An applicant should identify the records sought and explain their relevance rather than assume that every private financial document can be demanded without legal process.

What Is Interim Child Maintenance?

Interim maintenance is financial support ordered while a maintenance case is still pending.

Its purpose is to address appropriate support needs before final determination of the dispute.

Under the Punjab-amended Section 17-A, the Family Court is required to fix interim monthly maintenance at the prescribed stage of the proceedings. The provision also addresses the monthly payment deadline and consequences of default.

Important: Section 17-A has been amended in different jurisdictions. The precise timing, obligations and consequences must be checked against the current provincial or territorial law governing the case.

An interim award should not be confused with the final maintenance decree.

The final amount may be determined after the court considers the available evidence and applicable legal requirements.

Does Child Maintenance Increase Every Year?

Living expenses, educational fees and healthcare costs can change over time.

The applicable legal framework may permit annual increases or provide a statutory adjustment mechanism.

For example, the Punjab-amended Section 17-A provides for a court-prescribed annual increase and specifies a 10% annual increase where the court has not prescribed one.

That provision should not be described as an automatic nationwide rule. Its application depends on the governing legislation and terms of the relevant order.

When reviewing an existing maintenance decree, parents should examine:

  • The actual monthly amount awarded.
  • Any annual increase expressly stated.
  • The applicable statute.
  • The effective date of the order.
  • Any subsequent modification or appellate order.

For disputes concerning unpaid amounts, enforcement requires separate examination of the decree and payment record.

Can Child Maintenance Be Changed When Circumstances Change?

A material change in a child's needs or a parent's financial circumstances may create grounds to seek reconsideration of an existing arrangement under the applicable law.

Examples may include increased educational costs, a change in medical needs, substantial changes in income or other relevant developments.

However, a parent should not unilaterally reduce or stop court-ordered payments based only on a claimed change in circumstances.

Any request for modification must follow the appropriate legal procedure.

Likewise, a claimant seeking a higher amount should present evidence establishing why an adjustment is justified.

Does Child Custody Determine Who Pays Maintenance?

Custody and maintenance are separate legal questions.

A parent having physical custody does not automatically resolve the other parent's financial obligations.

The applicable legal duties and court orders must be assessed independently of the child's residence and daily care arrangements.

In custody proceedings, the child's welfare is central. In maintenance proceedings, the court also examines financial needs and legally relevant resources.

Where both matters are disputed, legal strategy should avoid treating custody and financial support as interchangeable remedies.

Child Maintenance vs Wife Maintenance

Child maintenance concerns the child's financial support, whereas wife maintenance concerns the spouse's own legal entitlement.

The two claims may arise from the same family dispute but require different legal assessments.

For example, a divorce or khula proceeding may alter the legal issues concerning spousal maintenance, while the child's independent support needs remain relevant.

The specific entitlements and procedures depend on the applicable law and case circumstances.

Frequently Asked Questions

How is child maintenance calculated?

The Family Court assesses relevant needs, financial resources and supporting evidence under the applicable law. There is no universal fixed percentage that applies to all cases.

What is the average child maintenance amount?

There is no reliable standard amount for every child. The outcome depends on the evidence and circumstances of the particular family.

Are school fees included in child maintenance?

Education costs can be relevant. Fee vouchers, school records and other supporting documents help establish the amounts claimed.

Can medical expenses be included in child support?

Reasonable healthcare expenses may be relevant, particularly where documented medical treatment or continuing needs are involved.

How is maintenance assessed if the father works abroad?

Relevant foreign employment, business and banking records may assist the court, subject to jurisdiction, admissibility and the available evidence.

Can maintenance be awarded before the case ends?

Applicable Family Courts legislation provides for interim maintenance. The procedure and timing depend on the governing law.

Is a 10% annual increase mandatory in every maintenance case?

No universal national rule should be assumed. The Punjab-amended Section 17-A contains a particular annual-increase mechanism, while the applicable law and court decree must be checked in each case.

Can a parent stop paying maintenance after divorce?

Divorce does not automatically extinguish a child's financial-support rights. The applicable obligations and any existing court orders must be examined separately.

Can child maintenance be increased later?

A request for adjustment may be possible where legally sufficient grounds and supporting evidence exist. The governing law and existing decree determine the appropriate procedure.

Does a foreign child-support calculation apply automatically in Pakistan?

No. Foreign child-support systems and Pakistani maintenance proceedings may apply different statutory rules. The governing jurisdiction and enforceability of any foreign order require separate analysis.
